نَوَاقِضُ الوُضُوء (The Nullification of Wuḍuu’) from Matn al ʿIzziyah

فصل – Section:. نَوَاقِضُ  الوُضُوء (The Nullification of Wuḍuu’)

نَوَاقِضُ‮ ‬الوُضُوء أَرْبَعَة (The nullification of wuḍuu’ occurs in four cases):

الأَوَّلُ (The first case) is الرٌِدٌَة (apostasy), وَهِـيَ  كُفْرُ  الْـمُسْـلِمِ (and it is the abandonment of belief in Islam by the Muslim).

الثَّانِـيُّ (The second caseالشَّكُّ‮ ‬ (is the doubt  of the worshipper) فِي‮ ‬وُجُودِ‮ ‬الطَّاهِرَةِ‮ ‬(about being in a state of purity) أَوْ‮ ‬فِـي‮ ‬الْـحَـدَثِ (or about being in a state of impurity), أَوْ‮ ‬فِـي‮ ‬السَّابِقُ‮ ‬مِنْهَا (or [his doubt] about which one of the two state preceded the other), مَـا لَـمْ‮ ‬يَستَنْكِحَهُ (unless such doubt never leaves him) .

التَّالِـثُ (The third case) is الحَـدَث (the impure substances) وَهُوَ‮ ‬مَا خَرَجَ‮ ‬مِنْ‮ ‬أَحَدِ (and it is what comes out) مِـنْ‮ ‬أَحَـدِ السٌَـبِيلَينِ‮ ‬(one of two ways: [the front or the back]) عَـلَى وَجْـهِ‮ ‬الصِحَّةِ‮ ‬وَالإِعْتِيَادِ (as part of having good health and habit).

الرَّابِعُ (The fourth case) is الاَسْـبَاب (the causatives conditions that result in the nullification of wuḍuu’).

وَهِيَ‮ ‬ثَلاَثِةٌ (They (the causatives conditions) are three):

الأَوَّلُ [The first causative condition that results in the nullification of wuḍuu’ is]:

لَـمْسُ‮ ‬مَـنْ‮ ‬تُوجَـدُ‮ ‬اللَّذَّةُ (the touching that is done by someone who experiences pleasure) بِلَمْسِهِ‮ ‬فِـي‮ ‬الْـعَادَةِ (in the normal ways of touching), كَـالزَّوْجَـة (like [touching] the wife) or الاَمَـة (the concubine), إِنْ‮ ‬قَـصَدَ‮ ‬اللَّذَّةَ (when a man seeks to find pleasure), وَوَخَـدَهَا (whether he finds it) أَوْ‮ ‬لاَ (or not), أَوْ وَخَـدَهَـاغَـيٌرِ قَـصْدٍ‮ ‬(or he finds pleasure without seeking it), إلاَّ (except), الْـقَبْلَةَ‮ ‬فِي‮ ‬الْـفَمِ (the kiss on the mouth) تَـنْقُضُ‮ ‬مُـطلقاُ which absolutely nullifies wuḍuu’). فَـلاَ‮ ‬تُـرَاعَـى فِيهَا اللَّذَّةُ‮ ‬ (Pleasure is not a consideration when it comes to kissing the mouth).

قَـَـوْلُـنَا (Our statement)، لَـمْسُ‮ ‬مَـنْ‮ ‬تُـوجَـدُ‮ ‬اللَّذَّةُ‮ ‬بِلَمْسِهِ‮ ‬فِـي‮ ‬الْـعَادَةِ (“the touching that is done by someone who experiences pleasure in the normal ways of touching”) احْـتِرَازًا مِـمَّن (is not applied to the one who) لاَ‮ ‬تُـوجَـدُ‮ ‬اللَّذَّةُ‮ ‬بِـلَمْسِهِ‮ ‬فِـي‮ ‬الْـعَادَةِ (does not derived pleasure from touching in the usual way),‮ ‬فَـإنَّهَا لا تَـنْقُضُ (and it doe not nullify wuḍuu’),‮ ‬كَـالصَّغِيرَةِ‮ ‬ (like [touching] the small / young girl) الَّتِي‮ ‬لاَ‮ ‬تَشْـتَهَى (who is not an object desired), وَالـمُحْـرَمِ (and those women who are unlawful to a man) كَـالأُمُّ (like the mother), وَالْـبِنْتِ (and the daughter) وَالأُخْتِ (the sister) .

الثَّانِـيُّ [The second causative condition that results in the nullification of wuḍuu’ is]:

مَـسّ‮ ‬الذّكر بَنَفْسِهِ‮ ‬(touching the penis itself)‮  ‬الْـمُتَّصِلِ‮ ‬بِباَطِـن كَـفّهِ‮ ‬(continuously with the palm of his hand), أَوْ‮ ‬جَـنْبِه (the sides of it) أَوْ‮ ‬بِـباَطِـنِ‮ ‬الأَصَـابِـع (or the inside of the fingers) أَوْ‮ ‬بِجَنْبِهَا (the side of it) غَـيْرِ حَـائلٍ (without a screen)‮ ‬عَـمدًا  (whether intentionally) أَوْ‮ ‬سَـهْوًا (or inadvertently),‮ ‬التَذَّ (whether pleasure is derived by him) أَمْ‮ ‬لاَ (or not),‮ ‬مسَّهُ‮ ‬مِـنَ‮ ‬الْـكَمْرَةِ‮ ‬(whether he touched the main structure of the penis) أَوْ غَـيْرِهَا (or any other part of it).

وَلاَ‮ ‬يَـنْتَـنْقِضُ‮ ‬(Wuḍuu’ is not nullified) بِـمسِّهُ‮ ‬مِـنْ‮ ‬غَـيْرِ حَـائلٍ (when the penis is touched from behind a screen)‮ ‬وَلوْ‮ ‬كَـانَ‮ ‬خَـفِيفًا  (even if it is thin), وَلاَ (nor [is it nullified])‮ ‬بِـالْـفَهْفَهَةِ‮ ‬فِـي‮ ‬الصًَّلاةِ (by of laughing in the salaah), وَلاَ (nor) بِـمسِّ‮ ‬امْـرَأَةٍ‮ ‬فُُـرْجَـهَا (by the woman touching her vagina) عَـلَى الْـمَذَهَـبِ (according to this Madh-hab). وَقِـيلَ  (It has been said [by some of the scholars]) يَـنْقُضُ‮ ‬مُـطْلَقًا (that her wuḍuu’ is absolutely nullified). وَقِـيلَ (It has also been said [by other scholars]),‮ ‬يَـنْقُضُ (her wuḍuu’ becomes voided)‮ ‬إِنْ‮ ‬قَـبَضَتْ‮ ‬عَلَيْهِ (if she grasp the vagina) أَوْ‮ ‬أَلْـطَفَت (or caresses it), أَىْ‮ ‬أَدْخَـلَتْ‮ ‬يَـدَهَـا (that is to say, if she places her hand)‮ ‬بَيْنَ‮ ‬ شَـفْرَيْـهَا  (between the two lips of her vagina), وَلاَ‮ ‬يَـنْتَـنْقِضُ‮ ‬(but her wuḍuu does not become voided), إِنْ‮ ‬مَسَّتْ (if she touches) ظَـاهِـرَهُ (the outside of the vagina),‮ ‬وَلاَ (nor’ [does wuḍuu’ become nullified])  بِـمسِّ‮ ‬الدُّبُـرِ (by touching the buttocks) وَلاَ‮ ‬الاُنْـثَيَين (or the testicles),  وَلاَ‮ ‬بِـالاِنْـعَاظ (nor by the erection of the penis), مِـنْ‮ ‬غَـيْرِ‮ ‬لَـذَّةٍ (because of a reason other than pleasure),  وَلاَ‮ ‬بِـاللَّذَّةُ (or as a result of pleasure) بِـالنَظْرِ‮ ‬ (derived from looking at something),  غَـيْرِ‮ ‬مَـذْيٍ (as long as sperm has not been discharged), وَلاَ (nor [does wuḍuu’ become nullified]) بِـالتَّفَكُّرِ‮ ‬مَعَ‮ ‬اللَّذَّةِ‮ ‬فِي‮ ‬قَلْبِهِ‮ ‬ (by thinking about something pleasurable) مِـنْ‮ ‬غَـيْرِإنعَاظِ (without having an erection).

فَـرْعَـان‮ ‬-Two Sub-notes [pertaining to causative conditions that results in the nullification of wuḍuu’]:

الأَوَّلُ (The first point is that) القُرْقَـرَةُ‮ ‬الّشَـدِيدَة (the strong rumbling noise of the stomach) تُوجَبُ‮ ‬الْوُضُوءَ (necessitates wuḍuu’).

الثَّانِـيُّ (the second point is that) فال في‮ ‬الكتاب (He [ibn al-Qaasim] said) (in the book [al Mudawwanah]), إِنْ‮ ‬صَـلَّي‮ ‬(“If he [the worshipper] prays) وَهُـوَ‮ ‬يُـدَافِـعُ‮ ‬الْـحَـدَتَ (while suppressing the impurity [i.e. gas in the stomach]), أَعَـادَ‮ ‬أَبَـدًا (he must repeat it [the prayer] in every case.”) وَقَـالَ‮ ‬الأَشْـيَاخُ (The scholars have said), إِنْ‮ ‬مَـنَعَهُ‮ ‬ذَالِـكَ (“If suppressing the impurity)‮ ‬مِـنْ‮ ‬تَـمَامِ‮ ‬الْـفَرَئِـض(prevents him from completing the obligatory prayer), أَعَـادَ‮ ‬أَبَـدًا (he must repeat it [the prayer] in every case.”), وَإِنْ‮ ‬مَـنَعَهُ‮ ‬ (if it prevents) مِـنْ‮ ‬تَـمَامِ‮ ‬السُّنَـنِ (him from completing the sunnah), أَعَـادَ‮ ‬فِـي‮ ‬الْـوَقْـتِ (he should repeat the prayer within its designated time period), وَإِنْ‮ ‬مَـنَعَهُ‮ ‬مِـنْ‮ ‬تَـمَامِ‮ ‬الْـفَضَائِـلِ (however if it prevents him) مِـنْ‮ ‬تَـمَامِ‮ ‬الْـفَضَائِـلِ (from completing the supererogatory prayer), فَـلاَ‮ ‬إِعَادَةَ‮ ‬عَلَيْهِ‮ ‬ then he is not required to repeat it).”

التَّالِـثُ [The third causative condition that results in the nullification of wuḍuu’ is]:

زوال الْـعَقْلِ (the loss of consciousness) – بِـالاِغْـمَاء (through unconsciousness), أَوِ‮ ‬الْـجُـنُونِ (insanity) or أَوِ‮ ‬السّكرِ (intoxication), كَـانَ‮ ‬السّكرُ‮ ‬ (whether the intoxication is) بِحَـرَامٍ (by an unlawful means) أَوْ‮ ‬حَـلاَلٍ (or a lawful one), بِـنَـوْم (by sleep) إِنْ‮ ‬ثَـقُلَ (if it is heavy / deep) وَطَـالَ‮ ‬(whether long) أَوْ‮ ‬قَـصُرَ‮ ‬( or short), بِـخَلاقٍ (apart from) النَّوْم الخَـفِيف (light sleep) لا‮ ‬يَـنْقُضُ (which does not invalidate wuduu’)وَلَـوْ طَـالَ‮ ‬(even if it is long), وَهُوَ‮ ‬الَّذِي‮ ‬يَشْعُرُ‮ ‬صَاحِبُهُ (as long as he is aware of his companions), بِـمَنْ‮ ‬يَـذْهَـبُ‮ ‬وَمَنْ‮ ‬يَأْتِي (knowing who is going and coming), وَثَقِيل (while the heavy / deep sleeper is)  هُـوَ‮ ‬الَّذِي‮ ‬لاََ‮ ‬يَـشْعُرُ‮ ‬صَـاحِـبُهُ‮ ‬ (the one who is not aware of his companions) بِذَالِكَ (by that [light sleep]).

[The following actions] يُحْـرَمُ (are prohibited) عَـلَى الْـمُحْـدَتِ (for the one who has impurity on his body):  الصَّلاَةُ (Prayer), وَالطَّوَافُ (circumambulating the Kaʿbah), سُـجُودُ‮ ‬التِّلاَوَةِ (the Qur’ānic prostrations), وَسُـجُودُ‮ ‬السَّهْوِ (the prostration forgetfulness), وَمَـسُّ‮ ‬الْـمُصْحَفِ (touching a personal copy of the Qur’ān) بِـيَدِهِ (with his hands) أَوْ‮ ‬بِـعُودٍ (or a stick) وَحَـمْلُهُ (or carrying it) بِخَريظة (in a a bag)‮ ‬عِلاَقَةٍ (or suspended from a strap).

يَـجُوزُ‮ ‬مَـسُّ‮ ‬اللَّوْحِ (Touching the lawḥ is allowed) لِـلْـمُعَلِّمِ (for the teacher)عَـلَى‮ ‬غَـيْرِ‮ ‬وَضُـوءٍ‮ ‬(without him having wuḍuu’)،, وَمَـسُّ‮ ‬الْـجُـزْءِ (and touching a portion of the Qur’an [is permitted] لِـلْـمُتَعَلِّمِ (for the student), وَلوْ‮ ‬كَـانَ‮ ‬بَـالِـغًا (if he is an adult), وَيُـكْرَهُ (while it is disliked) لِـلصِّبْيَانِ (for the youth)‮ ‬مَـسُّ‮ ‬الْـمُصْحَفِ (to touch the muṣḥaf) الْـجَامِعِ‮ ‬لِـلْقُرْآنِ‮ ‬(which contains the entire Qur’an) مِـنْ‮ ‬غَـيْرِ‮ ‬وَضُـوءٍ‮ ‬(without him having wuḍuu’).

11. The Things That Make Ghusl [Major Ablution] Necessary from Matn al ʿIzziyah

12. التَّيَمُّمُ at-Tayammum (Dry ablution) from Matn al ʿIzziyyah

13. فَصْلٌ فِي الْـمَسْحِ عَلَى الْـخُفَّيْـنِ (Wiping over the Leather Socks) from Matn al ʿIzziyah

14. الْـحَيْضُ (The Blood of Menstruation) and النَّفَاسُ (The Blood of Parturition [Childbirth]) from Matn al ʿIzziyah
